A DUI case has become one of the most serious charges that can be brought against a law-abiding citizen. With society's tougher stance on the offense of Driving Under the Influence, the penalties have become increasingly severe with the passing of each year. Recently, our firm checked the number of amendments to the DUI Statute in the past 10 years. We found that the statute has been amended almost every year and sometimes multiple amendments have been filed in the same year. These constant changes make it difficult for the novice lawyer, or the lawyer who does not practice criminal law on a full time basis, to represent DUI defendants.

An Interesting phenomenon is that many lawyers who seek to represent persons charged with DUI will not represent anyone charged with Reckless Homicide. A Reckless Homicide charge can be brought where a person has died as a result of the reckless operation of a motor vehicle resulting from the consumption of alcohol. It has been our position for some time that the only distinction between a Reckless Homicide/Alcohol case and a DUI case is that someone was killed. If a lawyer does not feel competent to represent a client of a Reckless Homicide case, he or she should never feel competent to represent a client on a DUI Case.
